Workes Compensation 101

Workers compensation is a system of benefits mandated by law for most workers who suffer job related injuries or diseases. These benefits are paid regardless of fault, and the amount of benefits is limited by law. Check your States web site for benefit limits.

The policy provides a combination of two coverages: workers' compensation coverage, a type of no-fault insurance for employee injuries, and employers liability coverage, which covers an employers liability for common lawsuits brought by employees to recover damages for job-related injuries.

Covered injuries: Medical expenses for injuries sustained by an employee arising out of and in the course of their employment are covered in full. Disability benefits are provided after a waiting period, but are paid retroactively if the disability lasts longer than 14 days ( this may change depending upon the state).

Injuries not covered:

  • injury caused by the employee's willful intention to injure himself or another;
  • injury sustained while intoxicated;
  • injury caused by the employee's failure to use provided safety equipment; and
  • pain and suffering

Occupational disease An occupational disease is a disease that is due to causes and conditions that are characteristic of and peculiar to a particular trade or occupation and to which the employee is not ordinarily subjected away from his employment.

Employer's Liability

Coverage is provided for:

  • suits brought by injured employees, even in case of gross negligence;
  • suits brought by spouses or dependents of injured workers;
  • legal defense costs;
  • employees not covered by the workers' compensation law; and
  • other supplemental benefits

The basic limit of coverage available under this section is 100/500/100:

  • $100,000 for bodily injury;
  • $500,000 aggregate; and
  • $100,000 for disease.
